LPTWS damage during tire installation

I wonder when people will realize that if they treat everyone with respect and honesty the world would be a better place. There should have been no discussion about whether the sensor was broken earlier. As long as the tire has not been dismounted, the sensor should be intact. These sensors have been out long enough that the tire people should be familiar with them. Shame on them for acting so ignorant.
Good luck to you on this. Amazing how the GY rep is now calling you! Of course, they want your money! Keep us posted. I really believe this will have a happy ending.

Thanks for the tip. I just called my American Express and put a hold on the payment until further notice. Because I do alot of business with that card they were more than happy to help me out. I also filled a complaint with the Better Business Bureau and An OSHA complaint on another issue with the company store. This morning Goodyear offered to only pay for half the cost, not admitting any fault they only said it was a goodwill gesture. Now I'm really p****d.

As a retailer that takes AmEx they pretty much tell the retailer the will back the card holder all the way and the merchant is SOL with little recourse. You took the most effective path . I had the same kind of problem with roofing material. I told the retailer the material was of irregular lengths, but had to be installed. It took an extra day to installl the defective material, but I had no choice. The retailer told me I needed to talk to the manufacturer, the manufacturer told me to talk to the retailer. I put a stop on the charge....I didn't need to make any more calls, they ended up calling me with 'hat in hand' additude. I ony asked for a 25 percent discount from the beginning.....it wasn't like I was trying to take advantage of them. They quickly accepted my terms.....ALWAYS pay by credit Card. It can extend your warranty sometimes, but always gives you up to 120 days to dispute the charge....You are in absolute control for at least that 120 or so days. - Ron
 
Well now the fun begins. Goodyear is not budging from the 50% payment so it looks like small claims court. I'm waiting until next week to go to the courthouse to file to give them some time to reconsider. What they don't realize is that I will file for a larger amount for mounting and lost time from work and filing fees. How much I get who knows. What I need info on is if the store is corporate owned who would be the lawsuit as the defendent. According to Goodyear only the store manager. That sounds fishy.
Any real information would be appreciated. This will be Florida law.

check to see who owns the building through the county property appraisal site... if goodyear corporate owns it, it is 99% chance a corporate owned store... if not, it may shed some light on who does own the place
 
Last year I installed 2 new rear Khumo's on my '95. Pep Boys called to ask me to sit down while they told me how much it will cost to replace my inflation sensor strap that was broken in two. They said it was that way when the removed the tire. About $200 cost from my local Chevy dealer. After looking at the sensor I believed them. It was very scuffed up and looked as if it had been rumbling around inside the tire for years. Actually, what had happened is that the guy I bought the car from had that tire plugged just before I bought it (about 10,000 miles earlier). I got to thinking........... you know, I never could get a good balance out of that tire, and it was all cupped out and worn severely. Each time it was balanced the sensor would be held out against the tire to allow the balance to be done. Great, but each time I drove off, of course the sensor and shifted and tumbled to a different position sending the wheel out of balance again! The out of balance condition was not THAT bad, or I would not have lived with it for so long, but it was a nuisance.

I determined that the strap, in fact, had been broken before Pep Boys touched the wheel. To correct the situation on my dime, I picked up the sensor assembly and glorified 16" hose clamp that mounts it to the circumference of the inside of the wheel. I straightened the strap out on my bench vice (the former tire guy had literally ripped it off when he patched the tire) and took it to a local welder for a $19 weld to get the strap back in order. Pep Boys reinstalled and all was fine.

This may not be the cause of your problem, but I would have felt terrible if I had blamed the good folks at Pep Boys, and then found out that the strap had been broken for years.
 
Whom to take to court??

You have to name the store and let them sort it out. Keep it real simple but make sure you have pictures and documents.

The one who has the documents wins period or else it's he said she said. Most of the time when your case is called to make sure both parties are there the judge will ask both of you to go out into the hall and work it out. If you don't budge you will lose and the same goes for the store.

They cannot afford to spend a half day at best at the court house.

When you serve them they will call.
