NCM Motorsports Park update 10/20/2015

As you know, the NCM Motor Sports Park has been effectively shut down because of the alleged failure to abate noise and obtain occupancy approval for the site. Here is the update released today to the NCM Ambassadors who re[resent Clubs and other organizations like CAC.

"When the Detailed Development Plan was approved by the Planning Commission on 2/20/14, there were 6 conditions. The NCM very timely satisfied 5 of the 6 conditions. At issue is the condition that talks about the earthen berm and noise abatement with an intent of no substantial increase. That condition also required a Certificate of Occupancy. This was the first time in the history of Warren that a Certificate of Occupancy was required for land (the NCM properly applied for and received both a Building Permit and a Certificate of Occupancy for the garages, the start stand and the fueling station. WE have a building permit for the Holley Tower and once completed, we will properly apply for and receive a certificate of occupancy.

Condition # 5 is the one that we were not in compliance with. With the construction of the earthen berm at the Clark Circle property line, the installation of the Acoustifence at the Crump boundary line at the western end and the planting of 100 trees at the western end, we believe we are now in full compliance with the DDP.
An application has been filed with the Warren County Building Inspector for a Certificate of Occupancy as stated in Condition # 5.
In addition to being in full compliance with all 6 conditions of the DDP, we have done other noise abatement measures to help reduce the noise level to our MSP neighbors. These include:
• The construction of 22 garages adjacent to the track.
• The construction of the Holley Tower that is adjacent to the track.
• Adopting the SCCA standard of 103 maximum decibel limit 50 feet from the track for a single car. We will be purchasing special equipment that will make it much easier to measure this and to strictly enforce this limit.
• Installing approximately 300 feet of Acoustifence alongside the track at the western end.
On 10/19/15, the Building Inspector sent a copy of the Application for the Certificate of Occupancy to the Planning Commission staff for their review. We are hopeful the PC staff will complete their review in a timely manner and agree that the NCM is in full compliance with all conditions of the DDP. The Building Inspector will then issue a Certificate of Occupancy to the NCM."
