Speeding Ticket

Ok, I'm embarrassed to say it, but I just recently got a speeding ticket. I was going 95 in a 70 mph. Besides the $200 ticket, the local constable there said that since I was going 25 mph over the posted speed limit I'm ineligible for the defensive driving class to keep it off my insurance. I haven't got a speeding ticket in years, but I'm wondering what the effect on my ins. is gonna be. Anyone had an experience like this and would like to share the outcome with me? I'd really appreciate it.
 
Many insurance companies will forgive a single offense. If however you shoud aquire another anytime in the next 3 years be prepared for a fairly large increase. Thats been my experience through the years.
 
you can also take it to court... there are many web sites that advise the best way to go about that. Basically, if the cop doesn't show up that gave you the ticket, you get off scott free..

Does Plano allow 'deferred adjudification'... or did you get the ticket some where else outside of Plano? Not sure if I am spelling it right... but deferred adjudification means you stand in front of a judge, say sorry, promise not to do it again for 6 months, write a big check and leave. I did this in Frisco 2 years ago and it never showed on my record. I love some of these Texas laws!
 
LOL! No, I don't think that was me at 75 & McDermott. Maybe 75 & Legacy? Actually, I got the ticket just about a mile west of US 259 while on I20. The ticket says Gladewater, Tx. You know what's funny about the whole thing is that once I pulled over, he approaches the car, but stayed well behind my window until I had a chance to fish out my DL and insurance card and roll the window down. It was then that he came up to the window (I realize all this is just a safety issue with him). He told me he got me at 95 but that when I saw him I slowed down to 87. I told him that I had not seen him, but if I had I wouldn't have slowed to 87, but on down to 70. Anyway's, he steps back to his constable car writes my ticket up, comes back and asks me if I was carrying a weapon. I mentioned that I wasn't, but asked whether or not his timing off was just a little off on the question. He laughs and say's yeah, I guess it was. The ****er was that I was less than a mile from my turnoff. Sheesh.

Regardless of whether you decide to fight the case, do NOT agree to have the case heard (even if you plead no contest) by anyone other than a real judge. In California, since the courts are so overwhelmed with the three strikes law, they try to have a stand-in judge (who is a local attorney) hear the cases. Unfortunately, the local attorneys have a distressing habit of slamming you - both in the argument of your case as well as the imposition of penalties (at least in San Mateo county). Also, if there is a delay in being able to schedule the hearing (due to you demanding a real judge to hear your case), you might be able to negotiate something that doesn't get on your record (like getting a waiver of the prohibition on being able to attend traffic school since you were 25 over the limit...).
 
I'd hire an attorney and let him see what he could do.


25 over is enough of a headache..

Best to hire a professional.

Sorry to hear of your ticket. The reason you cannot go to traffic school or defensive driving school is because 15 mph is considered wreckless driving, so with 25 mph over you see why. It might effect your insurance a bit if you had any previous infractions. If you don't have anything I don't think so unless you have one of those insurance companies that want to find a reason to raise peoples rates.
 
I don't think, Nick, if it's your only driving offense that you'll be surcharged on your insurance. I believe most "preferred" companies forgive one moving violation.
 
Thanks for all your comments. I have 7 more days to decide what to do, but since I haven't had a ticket in years I may just let this one stay on my record. My insurance co. is State Farm and the agent there I've known for almost 20 years. I may run by them what they think as well.

By the way JBsC5 I may just very well look into having an attorney take care of it. I'll let you all know what happens.
 
Nick, if you are going to let the ticket ride (not fight it), be sure you confirm that the ticket will have no effect on your insurance with State Farm. I have been a State Farm policyholder for the past 13 years. After 5 years with State Farm, I got a ticket for rolling a stop sign. I had no prior tickets and no prior chargable accidents (accidents where I was at fault). State Farm still added a surcharge for three years. The cost of the surcharge was $1,800. The biggest irony was that at the time, I did not think that I had rolled the stop sign. However, I plead no contest rather than try to go against the presumption in favor of the citing officer. Then 3 years after the episode, the citing officer is fired for perjury committed on 3 separate traffic stops.... Sometimes, things are just not fair.
 
I'd fight it. I got one for going 48MPH over the speed limit which gave me two tickets for around $500, 5 points, and took my licence for 7 months. Went to the magistrate & they pretty much laughed at me. Apealed to that & went to court a while later. The judge didn't care to hear what I had to say and basically told me to leave. Got a letter in the mail from them though & they dropped one of my tickets, lowered the other to $150, dropped 2 points, and gave me back my licence.

I've always believed that if you let it go you're only hurting yourself. Fighting it NICELY though will usually get it dropped down some. If not they'll just deny your request, and you move along. So what do you have to lose really?

BTW... Depending on your driving record, it shouldn't affect it badly. I have State Farm & it did show up on my record with them. However... My insurance just went down $60 a year when renewing. LOL!
